Kurt Eichenwald Has Some 'Splaining To Do

So it doesn't look like Kurt Eichenwald's check-giving ways are going to disappear from the news anytime soon. [Portions of this post referring to reporting by Debbie Nathan have been redacted for our convenience, as Kurt Eichenwald states that she'll be the subject of a defamation suit.] In response to our initial post about the affair, commenter "stephenmaturin" left a timeline of events that transpired during the reporting of the story; it deserves to be seen by a wider audience. You'll find it after the jump. [Fact-checking in caps!]

The previous cases have firmly established a timeline of Justin Berry's actions that was previously published on several blogs [UNKNOWN; WE DISPUTE "FIRMLY."]. If you add in the $2,000.00 check, suddenly many matters become clear. [INNUENDO; UNCONFIRMED.]

  • July 24, 2004. Justin turns 18. [CORRECT.] About this time he starts advertising his services on the internet as a "male escort". [CLAIM UNVERIFIABLE.] At this time he also sets up the site "justinsfriends.com" [POSSIBLY INCORRECT. FIRST WEB ARCHIVE RECORD OF SITE: OCT 24, 2004.]
  • Nov. - Dec, 2004. Justin has a dispute [UNKNOWN] with his business partner, Greg Mitchel [ACCURATE; GREG MITCHEL WAS A SUBSCRIBER TO THESE SITES, AND THEN OFFERED HIMSELF AS A BUSINESS PARTNER; THEY MET IN OCTOBER, 2003; LAST YEAR MITCHEL WAS SENT TO JAIL ON CHILD PORNOGRAPHY AND SEXUAL EXPLOITATION CHARGES] , and quits the webcam business. [UNKNOWN.] His sites go dormant. [UNKNOWN; WEB ARCHIVE SUGGESTS THIS.] Justin is now a retired "camwhore". [NOT NECESSARILY ACCURATE; IN THE NEXT YEAR, EICHENWALD SAW BERRY SIGN ONTO THE INTERNET AND BE "quickly bombarded with messages from men urging him to turn on his Webcam and strip" AS PER NYT.]
  • May, 2005. Kurt Eichenwald discovers Justin and starts communicating with him. [CLOSE TO ACCURATE; EICHENWALD SAYS JUNE IN THE 'TIMES', BUT SAYS MAY/JUNE IN A LETTER TO ROMENESKO.] Justin supposedly has no idea that Eichenwald is a reporter. [ACCURATE, NO "SUPPOSEDLY" NEEDED, AS PER EICHENWALD.] At this point Justin has been out of the webcam business for about 6 months. [POSSIBLY.]
  • June 8, 2005. Kurt Eichenwald sends Justin Berry a check for $2,000.00 from Dallas. The check is received by Berry the next day in Bakersfield. [INACCURATE: EICHENWALD SAYS "VIRGINIA," AND THAT BERRY LEAVES VIRGINIA "DAYS LATER."]
  • Mid-June 2005. For no apparent reason Justin travels to Virginia [TIME FRAME UNCLEAR] and makes a deal with his former business partner Greg Mitchel to start up Justinsfriends.com. [POSSIBLE: WEB ARCHIVE HAS FREQUENT RECORDS FROM JUNE, 2005.] Tim Richards is brought in to help set up the website. [PROBABLE: TIM RICHARDS WAS "A MARKETER AND PRINCIPAL" OF THE SITE, AS PER NYT.]
  • June 19, 2005. Justinsfriends.com suddenly becomes active again. [POSSIBLE: WEB ARCHIVE.] Richards and Justin whoop up the site and Justin starts doing shows. EB15 advertises Justinsfriends.com. [UNKNOWN: EB15 BLOCKED FROM ARCHIVE.] At this point Justin is almost 19. [ACCURATE.] The site has a statement that all performers are over the age of 18. [UNKNOWN.]
  • June 19-25. Justin puts on several shows (these are legal, Justin is almost 19). He also uploads videos of himself when he was 17 as well as a video of him masturbating with an underage boy named Taylor. [THIS IS A FREQUENT CLAIM BY A PERSON WHO CLAIMS TO BE A BUSINESS PARTNER OF JUSTIN BERRY'S, TIMOTHY RYAN RICHARDS, OR HIS SUPPORTERS; RICHARDS WAS CONVICTED IN OCTOBER, 2006, OF DISTRIBUTION OF CHILD PORNOGRAPHY, AS WELL AS OTHER COUNTS. IT IS UNVERIFIABLE.]
  • June 30, 2005. Eichenwald meets Justin in Los Angeles, and supposedly gets Justin to agree to quit. [JUNE 30 DATE UNCONFIRMED; ESSENTIALLY ACCURATE; ON JULY 1, EICHENWALD LEAVES LOS ANGELES.] At this point Justin has been back in business exactly 11 days. [UNCONFIRMABLE, THOUGH EICHENWALD SUGGEST HE IS ACTIVE ONLINE]
  • July 3, 2005. Justin puts on a show. [UNCONFIRMABLE; UNLIKELY] (So much for his promise to Eichenwald). [JULY 3: EICHENWALD, IN DALLAS, DECIDES TO WRITE STORY, AS PER HIS TESTIMONY; ON JULY 5, HE INFORMED HIS EDITOR, LARRY INGRASSIA.]
  • July 4, 2005. Justin pays 2 young men $80 each to put on a show. [UNCONFIRMABLE AND UNKNOWN.]
  • July 5 or 6, 2005. Justin telephones Eichenwald and claims that his business partner Greg Mitchel is chasing him because he has quit (but he hasn't) and Eichenwald flys Justin for Texas for rehab etc. [INACCURATE: JUSTIN FLIES TO DALLAS ON JULY 7, AND EICHENWALD FINDS HIM "COUSINS" WITH WHICH TO STAY.]

    According to the site freecasey.com [SITE RUN BY FRIENDS OF TIMOTHY RYAN RICHARDS, WHOSE ACCOUNTS ELSEWHERE CONTAIN INACCURACIES AND UNCONFIRMABLE FACTS], the check wasn't simply a personal check. It was a cashier's check. Why did Eichenwald go to the trouble of obtaining a cashier's check that would be difficult to trace? [ONE OBVIOUS REASON MIGHT BE TO CONVINCE A SUSPICIOUS JUSTIN BERRY THAT THE CHECK WAS "GOOD."] Why did Berry go back into the porn business immediately after receiving $2000.00 from Eichenwald? [EVIDENCE UNCLEAR; ALMOST NO DESCRIPTIONS OF THE WEEK BETWEEN THE MEETING WITH EICHENWALD TO BERRY'S ARRIVAL IN DALLAS EXIST IN A RELIABLE RECORD.] Why did Eichenwald confuse these facts in his articles? ["CONFUSE" IS NOT ACCURATE. EICHENWALD'S TIMELINE IN THE ARTICLES IS UNSPECIFIC, NOT CONFUSED. FURTHERMORE, ACCORDING TO EICHENWALD, THE NYT REFUSED AT FIRST TO PUBLISH SIDEBAR CLARIFYING EICHENWALD'S INVOLVEMENT IN BARRY'S WELL-BEING; HOWEVER, HE NEVER CLAIMS THAT THE SIDEBAR WAS TO CARRY INFORMATION REGARDING THE CHECK.]
