<![CDATA[Obama 'Hope' Poster Artist Shepard Fairey Lied In Court, Lied To Bloggers, Covered Up Evidence]]> Contemporary artist Shepard Fairey got sued by the Associated Press for not meeting Fair Use standards when using their photo of Barack Obama as the inspiration for his infamous "Hope" poster. And now he's fessing up: Fairey lied in court.

It's old hat that Fairey's been embattled in a court case over fair use, the idea that something like an image can be used in the context of news if it doesn't sap value from the source's original work. That source, in this case, being the wire news behemoth Associated Press, who are more or less trying to find away to put a price on information so blogs and the like can't take "their" news and do stuff with it like talk about it. But for the time being, Fairey's the guy the AP's suing the pants off of because he's a high profile figure who created a high profile piece of art from their high profile photgraph. And they want some of that young, idealistic money shelled out to Fairey, who's made a grip from his posters. He's probably lost quite a bit fighting this.

In a recent court deposition, Fairey identified one photo as the one he used as the inspiration for his poster, while the AP identified theirs-taken by wire photographer Mannie Garcia-as the one he used.

Well, he "realized" early on that it was Garcia's photo that he had, in fact, used, and then deleted a bunch of shit on his computer to wipe clean evidence that he knew any better. Whoops. Time to confess!

In an attempt to conceal my mistake I submitted false images and deleted other images. I sincerely apologize for my lapse in judgment and I take full responsibility for my actions which were mine alone. I am taking every step to correct the information and I regret I did not come forward sooner. I am very sorry to have hurt and disappointed colleagues, friends, and family who have supported me in this difficult case and trying time in my life. I am also sorry because my actions may distract from what should be the real focus of my case – the right to fair use so that all artists can create freely. Regardless of which of the two images was used, the fair use issue should be the same.

Whoops. You can't forget: Fairey's also lawsuit happy to artists who ape or parody his stuff, so it's hard to feel too bad for Fairey, even if he is trying to cover his legal costs and make a complex argument by being an asshole to someone els just like him. Birds of a feather. Also, Fairey lied to Bucky Turco at ANIMAL New York in an email, but Bucky doesn't get his own apology from Fairey. Short end of the stick, these bloggers get. That's HOPE for you.

<![CDATA[Kari Ferrell Needs Pen Pals]]> Hipster Grifter pal Bucky Turco has posted a gen-u-ine letter from folk hero Kari Ferrell, who's currently in jail in Salt Lake City and way bored. Who has she met, during her incarceration? "Every one of those Homiez figurines."

She also says she's been reading a lot and working out and complains that the shoddy journalists at ABC "made me out to be a narcissistic racist." Which is certainly true!

<![CDATA[Poster Boy, Live In Action]]> Anonymous subway-based ad remix artist and minor obsession of ours Poster Boy has been caught on film! All we had before to identify him was this photo(shop). Animal NY's vandal-in-chief Bucky Turco spent a nice evening with PB in a Brooklyn subway station, just cold maxing and relaxing and shooting the breeze while carving up ads with an X-acto knife and attacking trains. We now have a definitive description of Poster Boy: a male wearing a hat, doing art. If you see anyone matching that description, call police immediately. (Not really, snitches!). <![CDATA[Banksy Unmasked?]]> nickwalker.jpegBanksy: millionaire street artist, fierce cultural critic, celebrity darling of the art world. The man's prestige has been immeasurably enhanced by his anonymity. He insists on it, and it gives him an air of mystery that only increases his allure to the media, fans, and collectors alike. An alleged photo of him was widely circulated last year, but it certainly didn't result in his real name being printed in his omnipresent media coverage. Those in his inner circle insist on strict concealment of his identity. Theories, of course, abound. But today, Bucky Turco at Animal NY believes he's stumbled upon Banksy's true identity. Combined with some corroborating evidence we got ourselves, the case is plausible—though far from proven. Now this would be big news:

This morning, we got a tip about a sighting of Banksy painting on the side of Thunder Jacksons in NYC. Bucky Turco went and took pictures of the work. Shortly afterwards, Gothamist and others proclaimed that the piece was in fact by Nick Walker(pictured)—another well known stencil artist from Bristol, England.

Well.

The piece at Thunder Jacksons is by Nick Walker. You can see the theme in his own photos on Flickr. Our own original tipster wrote in to say, "I stand corrected. It wasn't Banksy - it was Nick Walker...the pics of the artwork show a signature that happens to be Nick Walker's. Youtube has some videos of Nick Walker working and he is the guy who was at TJ's last night."

But, asked for more information, the same tipster added this: "While he was outside doing his stencil sombody asked if he was banksy and he said he was."

Nick Walker said he was Banksy. [This is also corroborated by Gawker commenter chickenjungle, a.k.a. Abbe Diaz, here. She says she was at Thunder Jacksons last night and heard Walker say the same thing]. With that in mind, allow us to quote liberally from Bucky Turco's just-posted item at Animal NY:

According to a waitress at the newly stenciled Thunder Jackson restaurant, who witnessed Banksy painting the wall last night, "the whole thing took him about 15 minutes." When asked if she was positive it was Banksy, she emphatically stated "yes," and then awkwardly added, "Banksy is Nick Walker, they are the same person. Oops, I don't think I was supposed to say that." When pressed on why Banksy would use different names, she spilled, "He uses that identity because of visa and passport issues." The waitress added that Banksy is going to make a big announcement about his identity but not while he's in town, "He has a whole master PR plan, but he's waiting till he leaves the country."

Wow. If true.

Walker is often described as a predecessor, friend, and/ or rival of Banksy, and has certainly benefited from Banksy's publicity himself. He told Bloomberg last month:

Walker said that he had got know Banksy in Bristol, western England, in the late 1990s when he was invited to be part of the ``Walls on Fire'' group of graffiti artists.

``We don't talk too much now,'' he said.

Now let's run through the case against this theory. It started with an unsolicited tip. It has only a handful of sources. Theoretically, any of them could be lying, exaggerating, or misinformed. But it's worth noting that none of them have any readily apparent reason for making any of this up. We'd be happy to hear some art experts weigh in on Nick Walker vs. Banksy from a technical angle; but the similarities in their styles are obvious and unmistakable.

So, smart people: is Nick Walker Banksy?
