I haven't followed this case closely, but I remember reading that after eliciting basic facts the prosecutor did not press the victim. I assume he couldn't do it because he knew she would lie.

@homoviper: It's a stereotype, but like many stereotypes, it makes good "theater" because it has some basis in fact. That is, it happens frequently that abuse victims try to shift blame away from the abuser. But the fact that the supposed abuse victim denies being abused is not open-and-shut proof of abuse. It does happen, not perhaps very often, but sometimes, that a domestic violence case does amount to a misunderstanding that escalates, and nobody is the clear aggressor.
It certainly doesn't look like the Giraldo incident is this kind of "misunderstanding," but it's important to the cause of justice to weigh this case on its merits, not just to jump to the conclusion that her denial is something victims "always" do.
@Nic Fit: Fortunately, I'm pretty sure that they're trying this in front of a judge, not a jury. I'm hoping/assuming that he'll be able to see through this, based on past exposure to POS spousal abusers and the spouses they've cowed into backing them up.
