    Hmm. Admit it people. He does look a little tempting. Not to say I support hit and runs, mind you, but I would love to smack him with the door. I mean.... If you saw him get hit by a car in, let's say "Napolean Dynamite" you'd have a hard time surpressing a giggle.

    How about "assault with a deadly weapon, i.e., an SUV". I don't think you need to show injury, that would be battery, right? Or is that MPC and not NY law. Where are the 1Ls?

    @resipsaloquacious: It depends. I'm not a lawyer, but not long ago, as a pedestrian I got hit by a livery cab when I had a green light in a crosswalk. It was so cozy in the police car, and so chilly outside, the cops needed me to get out of the ambulance and give my statement through their half rolled-down window. The driver didn't even get a ticket.

    My understanding of the NYPD official process is that the thoroughness of the investigation is proportional to the niceness of the weather. All that "assault with a deadly weapon" stuff is just made up for the teevee shows.

    @resipsaloquacious: For criminal assault, injury is necessary. I had to look it up myself. I think it's not necessary under the MPC, or at common law.

    @resipsaloquacious: Oddly enough, vehicular assault requires injury as well. But he could presumably have been charged with attempted assault.

    @irishflyesq: Wow. A madman could have all the necessary intent to mow down a shitload of pedestrians, but, if he misses them, he is scott free. I have to believe there is something in the NY Penal law they could have jammed this Fox guy up with, had they wanted to.

    @resipsaloquacious: True, the stache needs to go, but think about what the other side's putting up there. I haven't seen Broderick, but I have a great mental image of what a Fox newser with an anger management problem looks like.
