Yes, you didn't technically commit a crime. You damaged the integrity of your office, which is not a crime, but which is a far more powerful thing: it is going back on your promises as a leader.
You were caught discussing, on tape, repeatedly and in detail, a crime you wished to commit. Which is completely inappropriate behavior for anyone in a leadership position. If you had any integrity, you would apologize for abusing your office by resigning. Instead you have confirmed and amplified your [douchebag]-ness by entirely missing the point of the case against you.

@gnipgnop: I think he (or some spokesman) said that he did it now because he had reason to believe that Blago was about to sell the seat and appoint someone to the Senate, so he wanted to make sure that didn't happen.
Others have said that Fitzgerald wants to make sure that he won't lose his job next month.
@The One: I've heard that Fitzgerald is in fact quite angry that someone from the Ram Manual Gazette periodical pressured him to move sooner than he'd like. Those hammer-wielding shepherds can throw some weight about.
