Sounds along the lines of "I'm not worried if my phones are tapped *I'm* not saying anything wrong." Nothing more than an excuse to make other peoples' business your own under the pretext that they should have known better and thus don't deserve privacy.

The chick they were flolicking with--and to whom they apparently GAVE a tape of such a frolic--was a known famewhore drug addict with a criminal history. That's the main factor in why this tape got out there. I think Gayheart and Dane's personal responsibility to not do stupid things (like tape this and give the tape to someone like Peniche) is greater than Gawker's responsibility to respect their privacy.
So perhaps the more accurate quote should have been "if you don't want a sex tape on the internet, don't give it to drug-addicted alleged prostitute!"

TMZ reported on August 17 that Marty Singer was planning to sue on behalf of Dane and Gayheart...so why did it take nearly six weeks for anything to be filed? Oh, I know: because everyone had all but forgotten that the tape -- which gave Dane and Gayheart more free press in one day than they'd seen in the past 10 years -- even existed, and a lawsuit would surely put their names back in the headlines.
Also interesting is the fact that the season premiere of "Grey's Anatomy" is tomorrow night. So, yeah, that's about all I have to say.
@mattchew03: You may be right, and you probably are right, but on behalf of lawyers everywhere, a well-written lawsuit doesn't write itself. Six weeks is nothing to research and write a good petition.
WTF are they even suing over? Which effing state statue are they pegging this lawsuit onto? That Gawker obtained the video illegally? Or that dispersing it online constitutes some kind of slander? Which state are they filing the suit in? So many questions!

When it comes to details, this is pretty much all they've reported so far: "[Dane and Gayheart claim] Gawker.com had not only unlawfully posted almost 4 minutes of the private video that was shot behind closed doors, but 'maliciously' distributed the video and included nude shots of the fabulous threesome." ... "Dane and Gayheart want more than $1 million in damages. Their lawyer -- legal pit bull Marty Singer -- is also asking for an injunction to pull the plug on the video."
@snugbug: The tape was previously listed on an evidence receipt after it was confiscated by the Hollywood Vice Squad. Maybe knowing receipt of stolen property? But I think that is a criminal cause of action, not a civil one.
I'm sure their lawyers will claim invasion of privacy, intentional infliction of emotional distress and the usually hullabaloo like that. But I can't imagine their legal case has a leg to stand on.
