    There used to be this great little website-game (for men) where you were presented with a bunch of urinals and men using various ones and the object was to select which urinal was the most anti-homo one to use for yourself.

    @LEHLegacy: YES!! That was great. The right choice was determined using two rules. Rule 1 was choose the urinal farthest from any occupied urinal. Rule 2 was among the urinals satisfying Rule 1, choose the one farthest from the door. Ever since I saw that game, I've noticed that these rules are nearly a perfect prediction of which urinal a guy chooses in a public restroom. It's amazing.

    This case puzzles me so much--not that I haven't enjoyed watching that toad Larry Craig be publicly humiliated, but isn't the entire arrest based not on anything Craig actually DID, but on what the officer assumed he WOULD do, if given the chance?

    @tewkesbury: Well, think of it this way -- if you go to buy pot, and the dealer is a cop, they don't wait for you to go home and spark that doobie, unfortunately. They arrest you right there. I don't know if that is an apt analogy, but I think it kind of works.

    @bringmemyTofu: Not a great analogy, I think, because buying pot is a crime and sucking dick isn't, maybe not even in a public restroom. How does Officer Dave know that Craig wasn't just trying to make contact with a plan to meet him outside the toilet and go have some fun in a less public place? I mean, it's not like nobody's ever done that before.


    I know a lot of Gawkerites love that a Republican senator is outed in such an embarrassing way, but the idea that the Minnesota airport police assigned this cop to sit in a men's room stall and wait to bust gay guys (who may or may not be closeted, who may or many not be Republicans) who wave at him under the divider is kind of pathetic. Also, I think, very anti-gay.

    @bboston88: No, that's different. Sex for money is illegal. There's no way of knowing that Craig was going to offer the cop any money. I'd think it rather unlikely, actually. Not that I have any experience in that particular situation . . .

    @bringmemyTofu: I'm also not an attorney, but I think that it would probably up to the judge -- or the jury, if Craig were to request a jury trial -- if s/he (or they) interpreted the toe tapping as a sign for sex.


    Of course, there may be a similar case in Minn. that provides some sort of precedent. Were there similar cases? How did the courts handle them? What was their reasoning?


    My take on this: If there was an undercover cop in this bathroom with a knowledge of the signals, i.e., a (minor) sting operation, then one can bet that the cops probably knew what they were doing legally because they devoted so much time and energy to it. But, time and time again, we've seen police go rogue.


    I could Westlaw this, but it hardly seems worth it. This is why they have newspapers in Minnesota.
